MINUTES FROM THE JULY 24, 2002 MEETING OF BOROUGH COUNCIL

The fourteenth regular meeting of the Hamburg Borough Council for 2002 was held this evening at the Hamburg Municipal Center with President Rick Boyd presiding. The meeting was opened with Pledge of Allegiance to the Flag and a Prayer.

Members Absent – Jeanette Heckman

A motion was made by Charles Figard and seconded by Diana Edwards to approve the amended agenda, adding the acceptance of a $5,000 grant for the Main Street Program.

COURTESY TO AUDIENCE

Cherie Reichard wanted to confirm that copies from the Borough Office were $0.25 a piece. President Boyd stated that she was correct. Ms. Reichard wanted to know why she received a piece of paper stating that she would have to pay $15 for research time as well as the $0.25 per page. President Boyd stated that if there was research involved for information she wanted, there would be a charge of $15.00 per hour for the research. There is an ordinance in effect.

A motion was made by Roy Heffner and seconded by Diana Edwards to approve the minutes of the July 8, 2002 meeting.

ENGINEER'S REPORT
July 18, 2002

SANITARY SEWER SYSTEM

· SEWAGE TREATMENT PLANT ISSUES

Flows at the plant are normal to low for this time of year. Treatment is within normal parameters.

The equipment for the dechlorination system has been installed. It is being run in the manual mode right now and work on the automatic system is in progress. TRC parameters are being met.

· MID-ATLANTIC CANNERS

                No charge

EDENBURG P.S.

Contracts for televising have been complied and are being signed. Systems Design Engineering, Inc. will schedule the start of the work.

SPECIFICATIONS

The solicitor and Systems Design Engineering, Inc. are meeting to bring the draft specifications to completion.

WATER SYSTEM

WATER PRODUCTION

The impoundment dam is full. The filtration system is back on line after a couple of days off due to an electrical control problem. Everything is running well and all levels look good.

WATER PROJECTS

The blow off project is continuing. The separator has been ordered and the project will be completed when it arrives.

The sampling pump and booster pump project are substantially complete.

The two small tears on the cover require heat welding to repair. The original installer has been contacted for repairs and is scheduling the work for a work crew in the area in the next 3 weeks.

NPDES PERMIT RENEWAL (no change)

Systems Design Engineering, Inc. has completed the renewal permit for the clarifier discharge at the water treatment plant. A letter from the PA DEP deemed the application administratively complete. It is now in the process of technical review. DEP contacted Systems Design Engineering, Inc. last week to ask for additional testing. These analyses require 3 weeks to sample and then we will forward this information to DEP.

SUBDIVISIONS/LDP

Wyndcliffe II – Connections are in progress.

Property Committee

7/9/02

The Our Town representative presented the following to the property committee:

Requested the approval to clean up the Mill Creek through town. Also looking to obtain grant, which would need to be submitted by the Borough. Discussion followed with the general consensus that the Borough has no problem with the clean up and would submit any request for grant money. It was pointed out that an EPA assessment for the area might be necessary.

The banners for the town are being manufactured. No specific time was reported on their availability.

It was re-iterated that the Borough crew would be able to supply the trenching necessary to run the electric for the X-mas tree at the parking lot.

Other property committee business:

The Bentley Circus sent the borough a letter stating that they had available dates in which they would be able to set up at our park. They requested certain dates, but due to the short time period we are unable to accommodate them. Suggestion was made to refer them to the fire department for possibly utilizing the field house property.

The highway occupancy permit and letter have been sent to the state. This is for the proposed light at 4th & Hawk Ridge. The Borough Manager will keep us apprised of the situation.

A letter has been sent to the state requesting information on getting the state roads examined for resurfacing.

Still investigating the possibility of a developing a well in the park area.

Recreation Board has recommended cleaning up the canal area to use it for fishing and winter ice-skating. Will look into a possible grant to accomplish. SDS to review area for recommendations on the erosion. Will have the tree trimmer review the towpath for clean up recommendations and look at the Dolly Hoppe property for creating a trail. Discussion on planting new trees in the park, with the suggestion that they may be sponsored.

Good News: The pool seems to be fixed, as it is not taking much additional water. The water readings are to continue weekly and reported to the property committee each month.

The Borough building electric is up, probably due to the HVAC. Need to review the exact circumstances from the monthly bills to determine when and why. Should have additional information next meeting.

NBRC to meet Friday the 12th to discuss the Kernsville Dam.

Still trying to determine how the RR property was deeded. Once this has been established, transference of the property can be completed.

Discussed the property maintenance code and reviewed the fee structure. Exact wording of ordnance needs to be reviewed.

OLD BUSINESS

On the recommendation of the Road Committee, a motion was made by Charles Figard and seconded by Leon Balthaser to award the bid for Correll Alley, Fern Alley and S. Hillside Dr. to Reading Site Contractors at a bid price of $80,655.00.

On the recommendation of the Road Committee, a motion was made by Charles Figard and seconded by Diana Edwards to award the bid for Patching on Second St., Sewer Plant Road patching, Laydown area of 12’ x 40’ and the Overlay of some of the plant area and new area to EJB Paving at a bid price of $38,685.00. This amount will be reimbursed by the Hamburg Municipal Authority.

Councilman Balthaser stated that the assessed value of the Dolly Haupt estate is $3,900. The taxes are approximately $95.00. Councilman Balthaser stated that the Tax Collector reported that the taxes are two or three years behind. Why not wait for the tax sale? Why didn’t we have it appraised? Councilman Balthaser stated that there were properties next to the aforementioned property and they paid less that $5,000 per lot. Councilman Balthaser asked if anyone really knew where the property was located. He had asked the chairman of the Property Committee to take him and show him where it is and the chairman didn’t even know where it is. President Boyd stated that the action was taken. Councilman Balthaser stated that the action can be rescinded. President Boyd stated that an agreement of sale has been signed. Manager Albright stated that there was only a letter of intent mailed to the seller at this time and we are awaiting the agreement of sale. President Boyd stated that Councilman Balthaser’s comments are noted.

NEW BUSINESS

A motion was made by Leon Balthaser and seconded by Charles Figard to accept the DCED grant of $5,000 for the Main Street Program.

SOLICITOR’S REPORT

Solicitor Speicher reported that there have been no new developments in regards to the pension issue with the police department.
