MINUTES FROM THE AUGUST 28, 2002 MEETING OF BOROUGH COUNCIL

The sixteenth regular meeting of the Hamburg Borough Council for 2002 was held this evening at the Hamburg Municipal Center with President Rick Boyd presiding. The meeting was opened with Pledge of Allegiance to the Flag and a Prayer.

Members Present –Rick Boyd, Leon Balthaser, Diana Edwards, Dale Schlenker, Charles Figard, Jeanette Heckman

Members Absent – Roy Heffner

Also Present – Lynda G. Albright, Borough Manager, Kim Y. Berger, Recording Secretary, Solicitor Speicher

Visitors – Kimm Montone (Pottsville Republican), Lily Hening (Reading Eagle), Nikki Murray (Item), Linda Rehring, Charles Henn (Moose), Bill Eschbach (Moose), Robert Berger (Moose)

A motion was made by Dale Schlenker and seconded by Diane Edwards to approve the amended agenda

COURTESY TO AUDIENCE

Charles Henn from the Hamburg Moose presented Sgt. Painter with a check for $1,000 to use towards the department.

In addition, Mr. Henn handed a check to the Borough Manager for payment of the tickets for Community Days. The Moose sponsored the purchase of the raffle tickets.

Linda Rehring was present to discuss an issue whereby she has received a bill for penalties because she has not connected to the water system and she has her own well. She is the tenant and the property owner is turning the costs over to her because she is purchasing the property. President Boyd stated that this was an Authority issue. She was advised to contact Lynda Albright and set up a meeting to discuss the issue and then meet with the Authority.

A motion was made by Charles Figard and seconded by Diana Edwards to approve the minutes of the August 12, 2002 meeting.

ENGINEER'S REPORT

August 21, 2002

SANITARY SEWER SYSTEM

· SEWAGE TREATMENT PLANT ISSUES

Flows at the plant are normal to low for this time of year. Treatment is within normal parameters.

The equipment for the dechlorination system has been installed. It is being run in the manual mode right now and work on the automatic system is in progress. The fiberglass enclosure has been installed for the control valves and cylinders. TRC parameters are being met.

Contracts for televising have been complied and executed. We are delaying the start of the contract until we get some rain to allow better conditions for televising and repairing the manholes.

SPECIFICATIONS

The solicitor and Systems Design Engineering, Inc. are meeting to bring the draft specifications to completion.

WATER SYSTEM

WATER PRODUCTION

The impoundment dam is below the upper intake. For the past several weeks, one filter has been run and Well 5 supplementing production requirements as required. As the impoundment dam approaches the lower intake, the plant’s staff is planning on shutting down the filters and switching to full production on the wells.

WATER PROJECTS

The blow off project is continuing. The separator has been ordered and the project will be completed when it arrives.

The small tears on the reservoir cover have been repaired.

NPDES PERMIT RENEWAL (no change)

Systems Design Engineering, Inc. has completed the renewal permit for the clarifier discharge at the water treatment plant. A letter from the PA DEP deemed the application administratively complete. It is now in the process of technical review. The additional analysis requested by DEP is being submitted.

HAMBURG CENTER

The Hamburg Center has requested to go on Hamburg water for up to a year to correct filtration problems at their facility. Systems Design Engineering, Inc. had many telecommunications with DEP and Hamburg Center on Thursday and Friday August 15-16, 2002 on procedures for this connection. An emergency meeting was requested for August 19, 2002 to discuss requirements with the Authority to open the system to provide water. A backflow preventer was installed on Friday August 16, 2002 in anticipation of providing water.

The Hamburg Center has requested the Authority reconsider the tapping fee proposal. Systems Design Engineering, Inc. will present these dollar figures at the meeting.

FINANCE COMMITTEE REPORT

ATTENDING: LYNDA ALBRIGHT, RICK BOYD, ROY HEFFNER, JEANETTE HECKMAN, DIANA EDWARDS, CHUCK FIGARD, DALE SCHLENKER AND SANDY CHRISTMAN

1, As reported at the most recent finance meeting, further discussion ensued concerning per capita tax delinquencies. Further information was provided by Sandy Christman, as well as our options to alleviate this matter. The matter will be discussed at a future meeting.

2. The second quarterly review of the current budget was presented by Lynda Albright for review. There are a few accounting issues to be addressed and corrected by account methods. It appears the budget is running a shade ahead of projected, but well within limits.

On the recommendation of the Civil Service Committee, a motion was made by Charles Figard and seconded by Jeanette Heckman to approve the Resolution adopting the Civil Service Rules and Regulations.

On the recommendation of the Borough Manager, a motion was made by Jeanette Heckman and seconded by Charles Figard approving the Fire Company’s request to close South 4th Street between Pine and Walnut Streets from 9a.m. to 3 p.m. on September 11, 2002 for the purpose of commemorating the first anniversary of the terrible tragedy caused by terrorist attacks on 9/11/01. (Part of the activities will include inviting the school children to the fire station, which is the main reason why they are requesting closure of the street)

On the recommendation of the Borough Manager, a motion was made by Diana Edwards and seconded by Leon Balthaser approving the request of the Heritage Day committee to close 4th Street from State to Pine and State Street from 4th to 3rd on Saturday, September 28, 2002 from 8 a.m. to 4 p.m. to hold their Heritage Day Celebration.

On The recommendation of the Borough Manager, a motion was made by Leon Balthaser and seconded by Charles Figard giving permission for the Jaycees to hold their annual King Frost Parade on Saturday, October 26, 2002, with a rain date of Saturday, November 2, 2002 with the same conditions as in the past.

SOLICITOR’S REPORT

Solicitor Speicher stated that he sent a letter to Lynda regarding the penalties for ordinances dealing with codes. Manager Albright stated that this will be discussed at the Property Committee.

Solicitor Speicher also stated that a letter was sent in regards to tax exempt status for the Historical Society. Manager Albright stated she had turned over the application directly to the Railroad Museum group in an effort for them to complete and submit by the September deadline. She will also discuss this issue at the committee meeting as well.
