MINUTES FROM THE AUGUST 11, 2003 COUNCIL MEETING The fifteenth regular meeting of the Hamburg Borough Council for 2003 was held this evening at the Hamburg Municipal Center with President Rick Boyd presiding. The meeting was opened with Pledge of Allegiance to the Flag and a Prayer. KreiderNAYES – None COURTESY TO AUDIENCE Moises Arce and the Citizens for a Better Borough stated that during the Personnel Committee meeting, the Public Participation guidelines were brought up and wanted the council to explain. Mr. Arce stated that there is freedom of speech. President Boyd stated that the policy that is being presented is not dis-similar to what has been in place previously. The specifics which are contained within the policy have come from the solicitor, consistent with other municipalities. The concept of the document is that the public has a right to state its case, then the council will deliberate on the issues that are brought before them. Mr. Arce stated that he agreed to a point. He does not agree that the public can be arrested for saying something that the President does not like. Mr. Arce stated that what is not right is the fact that the public can be ejected and then if someone applauds, they can be arrested. President Boyd stated that the ability to call a person out of order and removed from the session has always been policy. The policy is to clarify the position of council. In order to have someone called out of order and ejected has to have cause behind it. President Boyd stated that the meeting is to be run orderly. Mr. Arce questioned if the rules applied to the Council President. President Boyd stated that any member of the council can be called out of order by the rest of the council members. Solicitor Shollenberger stated that the rules are the same for everybody. Disorderly conduct is the same for everyone. Solicitor Shollenberger stated that anyone can say that they do not like a member of the council, however, they can not do it in a disorderly fashion. Solicitor Shollenberger stated that the rules are being put into place so that everyone has a right to speak before any action is taken however, behavior cannot be disorderly under the law. Solicitor Shollenberger stated that the policy has nothing to do with what is said, but in the manner in which it is said. The public must state things in an orderly fashion. Heather Breininger was present to question, Section A, to address council on any item of concern that council will be discussing. If the agenda is not available before the public arrives at the meeting, how can they be informed as to what is on the agenda. President Boyd stated that the agendas are available at the borough office prior to the meeting, at least one day if not two days prior to the meeting. Mrs. Breininger stated that she cannot come into the office during normal business hours. Maybe it could be posted on the website so people can be informed. Cherie Reichard stated that she wanted to question why the public could not address the council persons individually. They all head a committee. Why must it go through the President of Council and not be addressed to the chairman? President Boyd stated that when questions are raised from the public, he usually looks to the committee chairman to answer those questions. President Boyd stated that the questions are to be directed to the President and he will direct them to the appropriate official. Ms. Reichard questioned that at a committee meeting, should the chair be addressed and not the President of Council? President Boyd stated that she was correct, go through the chairman of that particular chairman. President Boyd stated that the structure of a committee is more on a discussion level and more informal. Ms. Reichard questioned if President Boyd would be removed from a Personnel Committee meeting if he makes derogatory statements? President Boyd stated that Mr. Arce was not removed. Solicitor Shollenberger stated that it depends on the words that were chosen to be said. Ms. Reichard stated that about a month and a half ago, there was a man in a wheelchair present to state his complaints regarding the poor conditions of curb cuts in town. Ms. Reichard stated that she wanted to inform the council that she had to be in a wheelchair due to back surgery and came downtown to go to the sidewalk sale. She actually got stuck on a poor sidewalk and almost toppled over. Ms. Reichard stated that the streets and sidewalks are in poor shape and is hoping that someone is going to take a look at the conditions of the sidewalks. Councilman Kreider stated that the Road Committee is in the process of prioritizing street repairs. John Leonforte, Code Enforcement Officer, is in the process of reviewing sidewalks that are in need of repair. Councilman Kreider stated that he is one of the individuals who has sidewalk that needs repair. As soon as the borough takes care of their sidewalk, he in turn will repair his sidewalk. Councilman Kreider also stated that the Finance Committee is working on a complete package of things that are needed. Ms. Reichard stated that she hopes that every council member will think very carefully about the public participation before a decision is made. The public is feeling like the council members are not working for the public, but against them. Ms. Reichard stated that she hopes council members will consider not adopting this policy. Charlie Hafer was present to request a 2 hour parking limit from January to April in front of his office. There is very limited parking. Mr. Hafer was asked to come to Safety Committee on August 19, 2003. He cannot attend and so he was asked to put something in writing before the meeting. Mr. Hafer also stated that vehicles traveling west on Franklin Street between 3rd and 4th Street have difficulty pulling out onto 3rd Street because of vehicles parking there. He is requesting that the no parking zone be extended. Mr. Hafer stated that the downtown area’s lighting should be improved. It is dim and should be made brighter. Kreider NAYES – None BOROUGH MANAGER'S REPORT The Borough Manager's report for the month of JULY, 2003, includes the following: Some time was still spent during July handling police personnel and political issues, meeting with residents and handling questions related to these issues, as well as working with council and attorneys. Spent quite a bit of time meeting with John Leonforte, Code Enforcement Officer, during the month to review and discuss various building and zoning issues he is working on. Also, spent time looking at various sites with John regarding complaints that were made on code violations. Handled correspondence and complaints as needed. Met and discussed with John Trubilla on various occasions options regarding the borough office software/hardware. We are currently looking at upgrading our present hardware to accommodate needs in the office for more efficient operation. Both John and Kim have contacted SSI and they have submitted their recommendations. John, Kim and I will look at this closely and a recommendation made to Finance to move forward. June Hilbert, Rec. Director and I interviewed another applicant for lifeguard position at the pool. We have a void in August for lifeguards that must be filled due to the many school activities starting and necessitating time away from the job. Worked on other personnel issues with non-uniformed employees. Follow-up letters were sent to those residents in Windsor Township who have yet to make appointments for in-home inspections regarding possible illegal connections to the sewer system. Eventually, this will be done throughout the borough as well. In addition to council meeting, attended Personnel, Property, Safety, Road, Finance, Recreation, Planning and Authority meetings. If anyone has any questions regarding my report, please feel free to ask. Following my report are the activities of my staff for the month of July, 2003. LYNDA G. ALBRIGHT PUBLIC WORKS SUPT. REPORT – JULY 2003 AUTHORITY PROJECTS Cut the weeds and grass around the dam and reservoir. A lot of street signs were repaired. This is an ongoing issue. A lot of time was spent cold patching around the borough. The crew started to seal the cracks in the streets. This is a long ongoing project. Weeds started to be sprayed. The weeds in the streams were cut. Spent a lot of time hot patching bad spots in the alleys and streets. Painted the garage roof. Spent a lot of time on repairing the roller. RECREATION AREAS Spent lots of timing mowing grass and picking up litter around the parks. Spent time cleaning up tree branches and repaired trails on the Greenway after the storms. Richard L. Pickel Public Works Superintendent Water/Wastewater Superintendent’s Report July 2003 Wastewater The motor control centers damaged in the burglary a month ago have been replaced and are operational. There were few problems during the period the power was off for the repairs. Heavy rain the week of the 21st raised the water level in the aeration tanks which made it difficult to operate the mechanical aerators and toward the end of the week they would not run at all and we had several exceptions to the discharge parameters. That week we had 2 by-passes at the main pumping station and the Edenburg and Ridge Lawn Stations were surcharged most of the week. The proper authorities were notified and reports were filed. In spite of heavy rain the following week there were no more problems with the discharge.We hauled a significant amount of sludge as liquid while the power was down in an attempt to keep odors from the aerobic digester to a minimum. We also hauled several loads of anaerobic sludge due to a clogged digester feed line and a broken valve. The line is now open and the valve has been replaced. Connection inspections have been performed in the majority of homes in Windsor Township and we expect to complete the project in the next few weeks. Water The new turbidity recorder has been installed at the Water Filtration Plant. The rains of the 21st shut the plant down on high influent turbidity and we ran on wells for several days. In that time #1 filter repairs were completed and we are now totally on surface water. The high speed pick-up on the 8" water main from the reservoir failed and was replaced. Brobst Water/Wastewater Superintendent During the month of July, I spent most of my time setting up appointments for inspections of homes for Edenburg and Ridge Lawn and establishing the spreadsheet for the inspectors. The web page continues to be updated. There has not been a lot of time to implement some of the changes that I would like. Weed notices and junk car letters continue to be sent. There have been quite a few issues with recycling and grass not being collected. I spoke with the owner and they will be striving to rectify the situation. Assisted the office staff with issues dealing with the accounting and utility billing systems. Completed the quarterly reports for payroll as well as grease trap letters and council reports. Removed articles from the building inspector’s office and assisted with moving things in the office. Set the office up in a more efficient way. Secured larger dumpsters for the pool area. The area was overflowing with trash. Assisted in completing paperwork for the Borough Manager. Compiled a software questionnaire and submitted to other municipalities via email. Received some responses and also had to call some municipalities due to the lack of internet at their sites. Spent some hours on July 27 organizing the storage room, server room and filing system. Completed various correspondence. Assisted June with finalizing plans for Mexico Day which was held on July 30. Pictures were taken. Everyone had a great time!! Recreation Director’s Report for July 2003 July 1st thru the 8th were very good days for both the pool and the playground. We enjoyed 7 straight days of sun and warm weather. On the 9th the rain was back. We started working on our Special day, which we all decided to use "Mexico" as our theme. We had 5 parents who volunteered to help join us. We had meetings every Tuesday before the pool opened to plan our activities for Mexico "South of the Border Day". We planned our Mexican menu for the food stand and we all worked on our decorations. Lots of parents donated home baked cupcakes to be sold to pay for our prizes and the decorations. This was a huge success. On the 15th of July, we had our first pool swim and dance. Our attendance was very good. We used a different D.J. this year and the kids enjoyed his music and light show. Our playground programs are going well. The baton twirling has been a big hit. The craft program is still struggling for attendance. We may possibly change the time of day next year. We have crafts from 9 to 11 Mon., Wed. and Friday. I’m afraid it may be too early in the day. July 25th thru July 28th were fairly good days, although the weather could be warmer for this time of the year. July 30th our Mexico day was beautiful sunny and 84. Our attendance was good and we enjoyed the day. The food was good and we sold all the special Mexican food we made. The children enjoyed all the games and the piñatas. We were fortunate that we had a total of 27.75 left in our cupcake fund money left over for the next year. We thanked all the parents for their help and we encourage them to help again next year.

OLD BUSINESS Chairwoman Jeanette Heckman read the full report on allegations against Chief Zelinsky. A motion was made by Jeanette Heckman and seconded by Charles Figard to make this report part of the minutes. ROLL CALL: AYES – R. Boyd, R. Heffner, J. Heckman, C. Figard, L. Balthaser, D. KreiderNAYES – None Report Regarding Allegations Against Chief Zelinsky The procedure of review involved the following steps: 1., the written complaint by the individual claiming the misdeed, 2., a review by Mayor Del Rosario of the complaint, and 3., finally, review by the Personnel Committee. Each complaint was reviewed to the best of our ability in an unbiased manner. Each complaint was reviewed separately. Complaint 1. Unprofessional Demeanor This complaint involved a dog at the Hamburg Park during the Memorial Day weekend. The complainant states she/he was holding a 7-month-old Mastiff puppy. When complainant placed it on the ground, complainant stated that Chief Zelinsky approached he/her in a rude and unprofessional manner and told him/her dogs are not allowed on the park. Chief Zelinsky states that the rules of the park are posted at no less than six (6) different locations including the entrances. He also states that the plaintiff began to berate him. Chief Zelinsky identified cause of possible complaint as an unrelated incident. Two witnesses gave written statements that Chief Zelinsky was courteous and professional during this incident. Mayor Del Rosario reviewed and investigated and found the complaint has no merit. He found the complaint to be unfounded. The Personnel Committee finds the complaint, however unfortunate, has no merit and is unfounded. Complaint 2. Missed Hearing It was brought to the attention of the Mayor that Chief Zelinsky failed to comply with a subpoena dated March 24, 2003. The Chief was given ten days to respond. Chief Zelinsky responded that he was there, had spoken with Officer Gehring, an Assistant District Attorney, and the defendant. Chief Zelinsky spoke to the Assistant District Attorney and requested and received permission to be on standby from the office which was immediately granted. Mayor Del Rosario, after investigating, found that the A.D.A. remembered speaking with the Chief. Several different trial dates and conflicting reports were given to the Mayor. Due to a lack of proof, Mayor Del Rosario deems this complaint unfounded. The Personnel Committee deems this complaint unfounded. Complaint 3. Fraudulent Time Sheets This complaint from the Mayor states that Chief Zelinsky put two hours time for attendance at the February 10, 2003. He states that Chief Zelinsky’s name was not listed in the minutes as being present at the meeting. Chief Zelinsky was quite certain that he had attended the meeting of February 10, 2003. His point of reference was missing an important meeting at home with his wife and a painting contractor. Kim Berger doesn’t recall one way or the other if he was present. Some members of council felt that he was there and chose not to speak. Visitors are requested to sign the attendance book, however some choose not to sign, therefore people present are not always listed in the minutes. Employees have usually not signed the registry. There is no credible evidence to prove or disprove this complaint. In addition, management employees are not required to fill in time sheets. The Mayor feels the complaint has merit. After careful review, the Personnel Committee finds that there isn’t enough evidence. It is unfounded. Complaint 4. Harassment The complainant claims she/he was treated unprofessionally during an interview with Chief Zelinsky regarding a conversation with a Hamburg Officer from the Berks County Communications Center. Chief Zelinsky states he was polite, cordial, respectful, and professional to the Complainant. A witness, Supervisor at the Berks County Communications Center, was present during the entire interview and wrote a letter stating Chief Zelinsky has always conducted himself in a professional manner and did so in this case. He stated that the Chief didn’t holler, degrade, or insult the complainant as alleged. Mayor DelRosario deemed the complaint to have no merit and deemed it unfounded. Personnel Committee deems the complaint unfounded. Complaint 5. Failure to enter Stolen/Missing Vehicle Registration Complainant alleges that his missing/stolen vehicle was not registered into
NCIC database. The complainant also had lost the license plate on his car. This
incident happened November 30, 2002. Car was subsequently located on a lot at
Fairgrounds Square Mall. The Chief states that this procedure is consistent with department and Berks County Radio Services. In addition, a Supervisor with 18 years experience confirms that proper policy was followed. After review and investigation of this complaint, Mayor Del Rosario finds it has no merit. He deemed the complaint unfounded. Personnel Committee deems it unfounded. Complaint 6. Failure to enter stolen vehicle, dated July 7, 2003 Regarding stolen vehicle documented through Incident Number 2002-5951. Vehicle was missing or stolen from Third Street on 12-01-2002 at approximately 14:30 hours. The vehicle was located 14 hours later, on fire by the Muhlenberg Township Police department. Hamburg Police Department was contacted at 04:52 on 12-02-02 to locate owner to determine if this was the stolen vehicle. Vehicle not entered because it was found before it was reported stolen. Mayor Del Rosario’s opinion is that this complaint is without merit. The complaint is deemed unfounded. The Personnel committee deems the complaint unfounded. Complaint is also untimely (in other words, many months after the incident.) Complaint 7. Unprofessional Demeanor Complainant states that he received a phone call from Chief Zelinsky in which he perceived an" arrogant and cocky" attitude because complainant went to the PLCB over excessive noise at a neighboring bar. Complainant feels as if he was brushed off by Chief Zelinsky. Chief Zelinsky responded that he personally addressed the noise complaint problem on ten different occasions. These ten contacts were documented with date, time, and reason for contact. These included: conducting an inspection, discussing the problem with the business person, the complainant, the building inspector, and others, surveillance of the area, assigning numerous coverage details to stem the alleged noise, etc. He states that in no way did he ever demean or minimize the concern of the resident. Mayor Del Rosario, after review and investigation found the complaint without merit and deemed it unfounded. Personnel committee deems it unfounded. There is no set criteria to interpret the allegation. Complaint 8. – Fraudulent Time Sheets Complainant presented time sheets at July 7, 2003 Hamburg Borough Council Meeting which he deemed evident as not fulfilling Chief Zelinsky’s forty hour work week contractual agreement. Personnel Committee deems this evident without merit. Chief Zelinsky, as a management employee, is not required to fill in time sheets. (Time sheets were his personal guideline, not an official record.) If one scrutinizes the near three years of employment as Chief, one discovers that in many instances, he has worked well over the forty hour work week required and never less than eighty hours in a two week pay period. The allegations appear to be unfounded. In all cases, Chief Zelinsky addressed the fact that the complaints were received in a manner that is inconsistent with the current internal affairs policy that is in existence to specifically handle complaints against members of the police department including the Chief of Police. Complaints 2, 5, 6 were not signed by the complainant nor were they timely. The policy of using a standard official form, signed by the complainant in the appropriate space, and completed in a timely manner, should be the exclusive source of information in the future. Mayor Del Rosario spent a great deal of time investigating and sorting out the details. Personnel Committee painstakingly deliberated over the complaints and all existing documentation. We have put together this summary to the best of our ability. We have no legal background nor knowledge of police jargon, and have tried to be impartial and fair in every way. It is my ardent hope that the Hamburg Police Force, the Chief of Police, and the Mayor can work together as a team and support each other strongly. This would be a good time to learn from our mistakes and change a negative into a positive. A good system is based on mutual respect and understanding. Personnel Committee holds each of the policemen, their families, and the Mayor in high regard. They are here to protect each and every one of us. Let us allow them to do their job with the utmost authority. PERSONNEL COMMITTEE-Jeanette Heckman, Chairwoman, Scott Kreider, Charles Figard An executive session was held from 8:10 p.m. to 9:15 p.m. to discuss further allegations against the Chief of Police. Mayor Del Rosario stated that he had received 4 other complaints. Three have been unfounded and the fourth will be discussed with the Chief of police. Mayor Del Rosario stated that the weekly meetings between the Chief of Police, Mayor and Council President will continue to attempt to progress with a professional working department.NEW BUSINESS Mayor gave the proclamation for Heritage Day, Saturday, September 27, 2003 from 6 a.m. to 4 p.m. No parking on State Street between 3rd and 4th Streets No parking on the South side of State Street between 2nd and 3rd Streets No parking on S. 4th Street between State and Pine Streets No parking on the east side of 4th Street between State and Island Streets No parking on the north side of Island Street between 3rd and 4th No parking on 3rd Street between State and Washington Street. On the recommendation of the Personnel Committee, a motion was made by Jeanette Heckman and seconded by Dale Schlenker to appoint Ronald L. Kreider On the recommendation of the Personnel Committee, a motion was made by Jeanette Heckman and seconded by Dale Schlenker to approve the "Public Participation Guidelines" as presented. (Discussion: Councilman Balthaser stated that he had a problem with the policy and that if the public wanted to address him, it should be allowed without going through the President. Mayor Del Rosario stated that he wanted to be excluded from the policy. He stated that he is not a member of council and if they public has something to address with him, they should be allowed to do so. Councilwoman Heckman stated that there needs to be some revisions to this policy. A motion was made by Jeanette Heckman and seconded by Scott Kreider to table this issue until revisions can be made.
