MINUTES FROM THE DECEMBER 17, 2001 MEETING OF THE HAMBURG PLANNING COMMISSION

The Hamburg Planning Commission met this evening in the Council Chambers of the Hamburg Municipal Center with Chairman Leon Balthaser presiding. The meeting was called to order at 7:00 p.m.

MEMBERS ABSENT: Diana L. Edwards, Bryon S. Ruhl, Jeffrey A. Metz

ALSO PRESENT: Eric A. Armusik, Richard W. Boyd-Council President, Lynda G. Albright-Borough Manager,

Denise L. Clare-Secretary

A motion was made by George Confer and seconded by Dale Schlenker to approve the September minutes

as presented.

VISITORS

Eric Armisik of 71 North 4th Street was in attendance regarding the situation at 72 North 4th Street. The problems have escalated since Mr. Armusik attended back in September. Lynda Albright stated that she knows that the police chief sent a letter but has not heard about the outcome. Lynda Albright thought the problem had been resolved, Mr. Armusik stated that it is worse and that he has had vandalism to his vehicle. Supposedly, the tenant’s lease was up at the beginning of December but they are refusing to leave and the owner is going thru the District Justice to get them evicted. Mr. Armusik stated that he calls the police about this 3-4 times per week. Leon Balthaser stated that he would speak with the Sergeant and find out what is happening to remedy this situation. Mr. Balthaser promised to get back to Mr. Armisik with some answers.

NEW BUSINESS

Greg Kohl was in attendance regarding the Heck Annexation. Lot 1 will be added to Mr. Heck’s current property and lots 2 and 3 will be sold off as building lots. Lots 2 and 3 are part of an old subdivision and are not changing. The water laterals are already installed to lots 2 & 3. There is currently no sewer on North Crescent Avenue and lot 2 & 3 are to small for on-site sewer. A grinder pump will need to be installed to pump the sewer up to Chew Street which goes into the gravity system. This will be discussed further with the Hamburg Municipal Authority.

The BCPC review letter basically has no problem with this project. The GVC review letter was gone over. Item #1 & 3 regarding the lot information will be taken care of. Item #2 regarding the GN#7 will be changed. There is a 20’ utility easement to the west of lot 2 at which time it is unknown who the owner is. Lynda Albright will check into the ownership of the easement. Item #5 regarding setbacks is grandfathered. A note will be added to the plans to cover item #6. Item #7 regarding slopes, Mr. Kohl is requesting a waiver on this. Mr. Kohl stated that houses with basement garages would need to be built because of the slope.

A motion was made by Dale Schlenker and seconded by Chuck Cuthbert to have a note added to the plans that Section 507 of the zoning ordinance be applied in the development of Lots 2 & 3.

The SALDO portion of the GVC review letter was discussed. 1. Request waiver of the scale of 1"+50’ scale. 2. Mr. Kohl stated that the prepared date of December 2000 is correct. 3. A plan showing the existing North Crescent Avenue water line is needed and will be added to the plans. 4. There is no sewer line on this portion of North Crescent Avenue. 6. This will be addressed by the Authority. 7. The Authority engineer has already reviewed the plans. 8. The certification will be changed to Hamburg Borough.

A motion was made by Dale Schlenker and seconded by Chuck Cuthbert to recommend to Borough Council to waive the slope requirements in Section 507 of the zoning ordinance.

A motion was made by George Confer and seconded by Chuck Cuthbert to approve these plans and recommend to Borough Council that they also approve these plans contingent upon the stated items being done.

CORRESPONDENCE

Lynda Albright received information regarding a subdivision review course at Albright College. It will be 3 Tuesday’s starting at the end of January and run 6:30-9:30.

There being no further business, and on motion of Chuck Cuthbert seconded by Dale Schlenker to adjourn the meeting at 8:46 p.m.
