MINUTES FROM THE JULY 12, 2004 MEETING OF BOROUGH COUNCIL The thirteenth regular meeting of the Hamburg Borough Council for 2004 was held this evening at the Hamburg Municipal Center with President Adam Dries presiding. The meeting was opened with Pledge of Allegiance to the Flag and a Prayer. Members Present – Adam Dries, Tammy Wilkinson, Jeanette Heckman, Martha Bertolet, Dale Schlenker, Charles Figard Members Absent – Tina Yoder Also Present – Kim Y. Schlenker NAYES – None COURTESY TO AUDIENCE President Dries stated that the Council discussed in executive session Rodger Gehring’s litigation. Cherie Reichard questioned that when a permit is issued, must the business
meet all the regulations? Ms. Reichard stated that the American House does not
have handicap accessibility bathrooms. Solicitor Shollenberger stated that the borough does not monitor ADA requirements, Labor and Industry does. Figard, D. Schlenker NAYES – None BOROUGH MANAGERS REPORT JUNE, 2004The Borough Manager’s activities for the month of JUNE, 2004 included the following: Was on vacation June 1 thru June 7, 2004. Held Staff meetings to discuss various issues. Attended a meeting with Allen Piper of the Reading Area Transportation Study, as well as borough officials, PennDOT officials, school officials, representative from Our Town Foundation and officials from neighboring municipalities to discuss the Transportation Study that will soon be taking place in the Borough of Hamburg. June Hilbert, Recreation Director and I interviewed a potential candidate for work as a substitute in the food stand for the summer season. John Leonforte and I attended the monthly Our Town foundation Board meeting for updates on a few issues relative to the Barta Bus and the traffic study to be done later this year and other issues as required. Barta Bus has started their new route through Hamburg on July 1, 2004. Other than a few minor problems, the new route seems to be working well. Met with Ken Pick of Community Development Office relative to the funding for the storm sewer project on 3rd Street and the paving of the municipal parking lot. It is anticipated that work will be done by the fall of this year, barring any unforeseen problems. Also, met with Doug Kramer of Synergetics and a representative from Thomas Gibbons & Associates, Engineers regarding the storm sewer project and parking lot paving. Discussed the changes, which need to be made to the initial plans and specs. Met with Attorney Sher (borough’s insurance company attorney), Rick Boyd and Tom Zelinsky relative to the newest lawsuit filed by Roger Gehring. Handled complaints as needed. Met with John Leonforte various times during the month to discuss zoning and code enforcement issues as needed as well as complaints received. In addition to the two regular council meetings, attended Authority Meeting, Recreation Board, Property committee, Personnel Committee, W/S/Public Relations. PUBLIC WORKS SUPERINTENDENT’S REPORT JUNE 2004 The crew spent time at the greenway trail, adding stones and trimming the weeds. Cold patching continues around the borough. Some streets will not even hold the patches. Painting of the pavilion roofs has begun. If the weather cooperates this will be done by end of July. Installed the electric line for the new scoreboard at the big field. Grass cutting has kept the crew pretty busy due to the wet season. The crew installed a lot of signs this month for the bus stops. Along with this, the stop markers were painted at different intersections. The cross walks and the other road painting was completed this month. Weeds at both flood control dams were cut. The crew went into the streams and cut the weeds. Met with John Leonforte and Barry Weaver (surveyor) about the curbing and road work. Weeds along the curbs and shoulders were sprayed. Repaired a 8" water main break on State Street. The crew cut the sewer plant field. Installed a ¾" water service line at 3225 Old 22. During the month I attended staff meetings as required.
Water/Wastewater Superintendent’s Report June 2004 Water All water for the month has been from the surface supply. The dam level is dropping quickly with the onset of summer and I expect we will need to supplement the surface source with wells before too long. The plant is, for the most part, working well. We still have a few issues to deal with in regard to backwash on number 2 filter. We are in the 3rd year of our 3 year cycle for lead and copper testing. The PaDEP has required that we reevaluate the sample site s we use. We have done that and the sampling will be done in July. Tony and I attended a 2 day seminar on water and wastewater system security. We repaired a broken water main in the 300 block of State Street. The consumer confidence report (CCR) has been sent to PaDEP and distributed throughout the community. Wastewater Basement and connection inspections are proceeding in the downtown area. Residents have been, for the most part, cooperative as to both inspections and making alterations to their connections. The results of the changes being made are difficult to quantify however during heavy rain events flows seem to rise more slowly and drop off more quickly then a year ago. There had been some speculation that the sump pump and roof drains at the Municipal Center were tied into the sanitary sewer. That is not the case. This was confirmed by a physical inspection and dye testing. These drains go directly to the storm sewers. The plant continues to problematic. We are having difficulty maintaining a chlorine residual. Higher chlorine doses create problems with ph and the total sludge load remains high. The high sludge load is delaying summer tank maintenance. That along with the time spent on I & I inspections is putting us behind, however I expect to catch up as the inspections in this zone wind down. Respectfully Submitted Keith L. Brobst Water/Wastewater Superintendent OFFICE MANAGER’S REPORT
This month was spent mailing notices to over 680 residents in Zone 2 for inspections of homes looking for the infiltration to the wastewater system. Also On June 30 mailed 230 reminder notices to those residents who had not called for an inspection. Over 2600 Consumer Confidence Reports were labeled, taped, sorted and mailed to all the water customers of the Authority’s system. Worked on various letters, included weed notices, park and pool letters and memos and letters to those residents who had problems with their inspection and asking residents to remove blockages from the water meters. Season tickets throughout the month continued on a regular basis. To date we are down by over 100 tickets compared to last year at the same time. I am working on compiling figures for the first half of the year and comparing them to last year. Quarterly grease trap letters, payroll reports, memos to employees have been completed. Attended quarterly training for Emergency Management. Attended two council meetings and staff meetings as necessary. Respectfully submitted, Kim Y. Berger
RECREATION DIRECTOR POOL MONTHLY REPORT FOR JUNE 2004 Both pool and playground opened June 2nd. The weather was in the mid 80’s the first week of the month so the pool enjoyed some busy days. We started our pool activities by the second week. This year besides the games we play, we are doing a Hamburg Community trivia. Each day at l:00 P.M. we play the Jeopardy theme over the speakers. We then ask a trivia question about our community. The first child with the answer enjoys a free piece of pizza. This has gone over very well. The last week of June, we had our public swimming lessons. We had 40 children enrolled. We had three children pass their swim tests. Our private swim lessons are scheduled for July 12 thru 16th. We had our first meeting with several parents to plan and prepare for our special day in July. This year we will be using the Mardi Gras theme and it will be July 28th. We plan to end the day with a swim dance. RECREATION DIRECTOR PARK MONTHLY REPORT FOR JUNE 2004 The month of June has been an active one at the Hamburg Park. The park opened Monday, June 7th and right away became the hot spot for fun and games for the youth of Hamburg. Attendance is high, with around 30 kids coming and going throughout the day. They enjoy activities such as tennis ball, grandstand, roofball, ping pong, and foosball. Each day, two organized activities are scheduled in which the kids are able to earn points and whoever accumulates the most points throughout the summer will be awarded a grand prize. The kids really enjoy the competition, making participation high. Wednesdays are craft days at the park and this month the kids made button mosaics, paper plate masks, tie-dye t-shirts, and decorated bowling pins red, white, and blue for the 4th of July. Wednesdays also mark the "special" competition day, with events such as a jello eating contest, water balloon toss, and a root beer chug. Other popular games this month included beach volleyball, dodge ball, and Uno. Points leaders for the month were Danny Ruppert, Mike Specht, and Jared Ruppert. June Hilbert
HAMBURG BOROUGH POLICE DEPARTMENT June 2004 ACTIVITY REPORT
None due to illness OLD BUSINESS NONE NEW BUSINESS On the recommendation of the Hamburg Civil Service Commission, a motion was made by Dale Schlenker and seconded by Charles Figard approving the following amendments/additions to the Civil Service Rules and Regulations: Establishing guidelines for an Oral Interview Board; Amending Section 4 (g) Physical Fitness Testing, section (d) 30-second Trigger Pull; and adding wording to Section 4(h) under Background Investigation. (Councilman Schlenker questioned why the change? Richard Boyd, Chairman of Civil Service Commission explained that the Oral interview Board had to be established because there were no alternates and this gives the board an individual from the borough to sit on the board, the requirements to be on the board are listed in the minutes of the Civil Service Commission. The second item is a request from the Chief, adding a section that includes a 30-second trigger pull on a non-functional semi-automatic weapon and the third item establishes guidelines for background investigation. SchlenkerNAYES – None On the recommendation of the Borough Manager, a motion was made by Dale Schlenker and seconded by Tammy Wilkinson approving the request for the closing of 3rd and 4th Sts. from Pine to State, and State St. from 3rd to 4th on Saturday, September 25, 2004 from 8 a.m. to 6:30 p.m. for the annual Heritage Day festivities. SchlenkerNAYES – None On the recommendation of the Borough Manager, a motion was made by Charles Figard and seconded by Tammy Wilkinson approving the request to give approval to the American House Hotel to extend the liquor serving areas of the Hotel to outside its building on Fourth and State Streets for use for special events only per the attached letter and drawing. (Discussion: Councilwoman Bertolet questioned if the owner would need additional insurance for this. Solicitor Shollenberger stated that this would fall under the PA LCB laws. All rules that apply will be governed by the PA LCB. The licensee is still responsible for the establishment. Discussion was held if these would allow the American Hotel to have the extension for all events. Solicitor Shollenberger stated that it was for all events, unless something can be worked out with the owner to prohibit it for certain events. Chief Painter was concerned about King Frost. Property owner Chris Madara stated that there would be an area set aside and be monitored. From his own liability standpoint, Mr. Madara stated that alcohol would not be permitted outside the area that is designated. No open containers will be allowed outside the area. Mr. Madara stated that the Our Town Foundation asked that his establishment have a "beer truck" for "Hamburg-er Day". Mr. Madara stated that he does not foresee "weekend events" where the alcohol will be sold outside of the business. Solicitor Shollenberger stated that the borough cannot regulate special events. Councilwoman Wilkinson asked the solicitor that if the council voted no, could he still have the extension from the PA LCB. Solicitor Shollenberger stated that he was unsure but he believed that it was a recommendation from the PA LCB that he get council approval.
