MINUTES FROM THE JUNE 14, 2004 MEETING OF BOROUGH COUNCIL

The eleventh regular meeting of the Hamburg Borough Council for 2004 was held this evening at the Hamburg Municipal Center with President Adam Dries presiding. The meeting was opened with Pledge of Allegiance to the Flag and a Prayer.

A motion was made by Dale Schlenker and seconded by Tina Yoder to approve the amended agenda.

Cherie Reichard questioned the appointment to planning commission, when will the interviews be held. Manager Albright stated that everyone would be interviewed at the next Personnel meeting.

Lori Guldin stated that the problems at the park are continuing along Park Road. President Dries stated that he has discussed this with Chief Painter.

A motion was made by Martha Bertolet and seconded by Tina Yoder to approve the minutes of the May 24, 2004 meeting.

John Leonforte presented the proposed zoning ordinance and explain process. Mr. Leonforte stated that the process of reviewing and amending the zoning ordinance has been going on for over two years. Mr. Leonforte sated that the purpose tonight was for the public to make comments and suggestions, not to debate if it should be adopted or not. Mr. Leonforte stated that the information that is suggested or questioned tonight will be compiled and the council will meet with the Planning Commission on Monday, June 21, 2004 to come up with a model to go to the County. In 30 days there will be another public hearing and then it will be presented to Council for adoption.

Mr. Leonforte stated that there has been a lot of combined districts to allow for a mixture of the uses. Spot zoning is not permitted.

PUBLIC COMMENT

Cherie Reichard questioned the area north of the Getty Mart. Why change the residential area to include commercial? Mr. Leonforte stated the districts were looked at as far as how the district is being used and how it may be used in the next ten years. Ms. Reichard stated that she thought it would be beneficial to have the businesses located in the downtown area, not spread all over the place. Mr. Leonforte stated that Village Center (VC) district encompasses single and multi-family dwellings, and allows for commercial ventures such as offices, etc. The VC district allows more than it does now.

Ms. Reichard stated that it would be nice to be able to print the ordinance off the web page rather than just look at it on the computer. Mr. Leonforte stated that we received the file from the engineer and was listed as read only. When it is put on the computer at a later time, once adopted, it could be put on as a pdf file.

Richard Machmer was present to question Met-Ed’s right of way and how he had to receive special permission to change his driveway, with the new zoning will this be the same for trees, fences, etc? Mr. Leonforte stated that this was a Met-Ed issue, not a zoning issue.

Fred Sheeler presented a list of concerns and or suggestions. Council members, Manager Albright, Solicitor Shollenberger and John Leonforte received a copy. Mr. Sheeler went through the list. Mr. Sheeler stated that changing the ordinance would be very beneficial and it needed to be done for a long time.

Audience members and Mr. Leonforte held a lot of discussion regarding the issues that were brought up.

Heather Breininger stated that the traffic flow should be studied. If the zoning is going to change and give more of an impact in the north end of town, the traffic will increase and will cause more issues. Parking is an issue as it is. We need to maximize parking in the borough. Mr. Leonforte stated that a business would not be allowed to come into a VC zone without following the other criteria, which would mean they would have to provide parking.

Kerry Delong stated that the traffic pattern needs to be looked at. This needs to be looked at now, not ten years from now.

Lori Guldin stated that Hamburg is going to grow, the parking and traffic flow really needs to be addressed. She suggested making 4th and 3rd Street one-way streets.

President Dries stated that it would be extremely important to come to the Planning Commission meeting on Monday, June 21, 2004 at 7 p.m. or speak to John Leonforte regarding questions or particular issues so that it can be clarified. A list is being compiled of all the questions, suggestions and comments and these will be discussed at the Planning Commission meeting.

A motion was made by Jeanette Heckman and seconded by Tina Yoder to approve the following reports: Borough Manager's Report, Public Works Supt. Report, Water/Sewer Supt. Report, Office Manager's Report, Recreation Director’s Report, Treasurer’s Report, Police Report and Property Committee Report.

BOROUGH MANAGERS REPORT
MAY, 2004

The Borough Manager’s activities for the month of MAY, 2004 included the following:

Held Staff meetings to discuss various issues.

John Leonforte and I attended the Our Town foundation Board meeting for updates on outstanding issues relative to the Barta Bus and the traffic study to be done later this year and other issues as required. Barta Bus is expected to start their new route through Hamburg July 1, 2004.

Attended a Dinner meeting at Cabela’s dealing with "Attracting New Business" which was sponsored by the Berks Economic Partnership and the Center for Community Leadership of Berks County.

John Leonforte and I met with an interested buyer for a vacant lot in the Borough and discussed the availability of sewer edu’s, as well as other building/zoning questions.

June Hilbert, Recreation Director and I interviewed potential candidate for work at the pool for the summer season.

Assisted as needed for the park/pool opening.

Handled issues and met with insurance representative regarding the on-going repairs to the municipal building as a result of water damage.

Spent time working with the solicitor in preparation of and amending both the contract for the Chief of Police and the police officers.

Met with John Leonforte, Code Enforcement/Building Inspector several times during the month to be updated on on-going projects he is working on, as well as the proposed zoning ordinance and the new Statewide Building Code.

Handled complaints as needed.

In addition to the two regular council meetings and regular and special Authority Meetings, attended Property committee, Safety Committee, Personnel Committee, W/S/Public Relations.

PUBLIC WORKS SUPERINTENDENT’S REPORT
MAY 2004

The crew has again spent a lot of time this month cold patching. We keep receiving complaints of areas of streets and alleys that need attention. We are doing the best job we can.

Due to the warm and wet weather the grass is growing at a very fast pace. We have spent a lot of time mowing; sometimes twice a week.

A lot of time has been spent at the park and pool. The pool was emptied, pressure washed and filled; the baby pool was repaired and cleaned and readied for opening; the baby swing set was painted and new baby swings added; the crew spent time assisting with cementing and repairing the tiles and coping at the pool; crew assisted with setting the poles for the new scoreboard and helping with the concrete.

Spraying of weeds has begun; cutting of the weeds in the creeks has been done; weeds at the flood control dams were cut.

On various occasions I have met with the building/zoning officer.

During the month I attended staff meetings as required.

 

Water/Wastewater Superintendent’s Report May 2004

Water

All production for the month was from the surface water source. The dam is full and the springs are running strong.

Information has been filed with the PaDEP to register our water sources in accordance with Act 220. This is new legislation, with the information to be used to manage Pennsylvania’s water resources.

I have received notice from the PaDEP that I have been issued a WA1 Water Operators certificate.

Wastewater

Zone 4 in home inspections are complete except for a handful of homes. We are trying to contact those residents to make arrangements to look at their connections. Repairs and alterations, are, for the most part, being made in a timely manner. Recent heavy rains and the resultant flows indicate progress in controlling I & I. Zone 2 inspections, downtown, will start in June.

The advent of warm weather has somewhat eased to chlorination problems we have been experiencing at the plant. Large swings in demand caused a permit exception early in the month. Since then, the effluent has been clearer and our chlorine consumption has been dropping.

We expect to start emptying tanks very soon for annual cleaning and maintenance.

OFFICE MANAGER’S REPORT
MAY 2004

Throughout the month, assisted the Recreation Director with a variety of issues and items that needed to be completed for the pool opening.

Updated the web page and municipal access channel.

I have been working with Met-Ed in regards to the issues of street lights.

I have also been working with a contracted landscaper to have those properties cut that are in violation of the weed ordinance.

Junk car letters and weed notices continue, as well as various other correspondence.

I started preparing the schedule for Zone 4 of the inspections for the Hamburg Municipal Authority. Letters were printed (over 650), labels were printed and extras were typed. The letters are set to go out June 1, 2004.

Attended two council meetings, one Civil Service Commission meeting and staff meetings as necessary.

RECREATION DIRECTOR REPORT FOR MAY 2004

We are in process of getting activities and programs for the pool and the playground set. I have had several meetings with our playground supervisor Rebecca Harrison in order to go over different events. We will be planning some night activity at the playground this year. One event will be a scavenger hunt on the playground and pool property. We will also be doing a pool trivia each day at l:00 PM. We will be asking questions about the Hamburg Community. First one to answer correctly will win a candy bar.

I have spent the second week of May purchasing the needed supplies for the playground and the pool. We have purchased new infant swings for the playground along with other games and balls. The Borough maintenance crew has been very helpful getting the pool and playground ready to be opened.

Third week of May I have two meetings with our pool managers, Kristen Ketch and Lauren Smith. Both pool managers have been certified with American Red Cross to teach and certify our new guards. They are training five new guards at this time. We have also been setting different activities at the pool. We plan on having swim dances twice a month on a Thursday evening. We will be doing a theme type swim dance. The first one will be a PJ party. They will get a dollar off if they wear PJ’s over their bathing suit. We will also have a supervised pillow fight in the pool. We will not be using real pillows.

We have received our Food Safe License from the state of PA, which I took the course so we are in total compliance. The food stand has been stocked and we are ready for our Memorial Day opening.

PROPERTY MEETING – MAY 25, 2004

MUNICIPAL BUILDING – 4 PM

All vehicles have been removed from the Canal Property-Thank You.

The Property Committee recommends Borough Council Opt In to the Uniform Commercial Code and prepare, advertise & adopt ASAP.

The Property Maintenance Code is not a part of the UCC and all outstanding fees will be addressed with a second billing and if no response a lien will be placed on the property.

The DJ’S office is complete with only a very few small problems to address; signage for the office was discussed.

John Speicher will prepare the updated Zoning Ordinance and have it advertised for the next Council Meeting; public hearing to be held at same meeting. The proposed Zoning Ordinance will be available at the Municipal Center for review; notice will be on the Borough Web Site and the MAC channel for information for review.

The Borough Crew will begin, this month, the painting of the crosswalk on 4th St. and the parking lines.

The painting of the fence at the Municipal Building is continuing. Looks Great!

The traffic sensors have been relocated at 3rd & Pine on Pine St. and Barta will begin running buses through the new route July 1st.

The Curb & Sidewalk Ordinance has been adopted and letters will be forth coming to affected residents for street construction as soon as surveying work is completed.

The preparation for the scoreboard at the park is just about completed in anticipation of the erection of the same.

Discussion of sidewalk vendors and their impact on other business was discussed; Lynda will research this issue.

With the increased usage of the Municipal Parking Lot, discussion ensued concerning assigned parking places for employees/governmental entities. Lynda was asked to come forth with a recommendation so this issue can be corrected.

The Property Committee recommends Council accommodate the Sidewalk Sale scheduled for August 14, 2004 as done for prior years.

New Applications for sidewalk/curbing/paving were distributed for further study.

The time spent by the staff to research & gather public documents was discussed; a fee schedule will be prepared for the future.

The overhead doors for the pool bathrooms and the railing leading to the second floor of the Municipal Center will be completed shortly.

A Memo was received from the Rec. Board on better communications. This issue will be corrected.

Deena Kershner, Main St. Manager, addressed the Committee on the need to fast forward recommendation for the Safe St. To Schools/Streetscape grants that will be available, to apply for shortly. The Committee gave Deena & John Leonforte the go ahead to pursue these grants with recommendations to be brought to Property Committee ASAP. There is $200 Million Dollars available and a Main St. Community (Hamburg) will have a great chance to receive funding.

OLD BUSINESS

On the recommendation of the Personnel Committee, a motion was made by Tina Yoder and seconded by Tammy Wilkinson to approve the contract for the Chief of Police for the remainder of 2004.

NEW BUSINESS

On the recommendation of the Property Committee, a motion was made by Dale Schlenker and seconded by Tina Yoder to give approval to the Greater Hamburg Business Association to hold their Annual Sidewalk Sale on Saturday, August 14, 2004 and to close South 4th from Pine to State Street and State Street from 4th to 3rd St. from 6 a.m. to 4 p.m., as has been done in the past.

On the recommendation of the Borough Manager, a motion was made by Jeanette Heckman and seconded by Tammy Wilkinson to authorize the Council President and Borough Manager to execute the contract documents for the third year of the Main Street Program.

(Comments by Dale Schlenker: This is a very critical issue. This is the 3rd time DCED has contacted us because the grants have not been taken care of. Apparently there is something that is falling through the cracks. This is $70,000 and it doesn’t cost us anything to request the money. I do not want this happening again. Manager Albright stated that some of the problems have been because of DCED, not the borough. Manager Albright stated that she never received this last contract paperwork in the office. If it was sent somewhere else, she was not aware of it.
