MINUTES FROM THE MAY 21, 2001 PLANNING MEETING The Hamburg Planning Commission met this evening in the Council Chambers of the Hamburg Municipal Center with Chairman Leon Balthaser presiding. The meeting was called to order at 7:00 p.m. MEMBERS PRESENT: Leon A. Balthaser, George E. Confer, Bryon S. Ruhl, Diana L.

Cheri L. Riegel, Ashley Riegel, A motion was made by Diana Edwards and seconded by Chuck Cuthbert to approve April’s minutes as written. ROLL CALL: Ayes-Balthaser, Confer, Ruhl, Edwards, Metz, Cuthbert, Schlenker VISITORS Attorney Richard Geschwindt was in attendance regarding the special exception application of Cheri & Ashley Riegel for their property on Mountain Avenue. Ashley & Kelly Riegel wish to build a house on the property which lies in a P-O zoning district. The driveway is already there and the septic has the required approvals. The 100’ isolation for an onsite well is no problem. Setbacks are more then met in every direction, the lot is 13+ acres. They wish to build on the Hamburg side of the property and not on the Windsor Township because the area is flatter in Hamburg. Zoning information for the Windsor side has not been checked into. John Leonforte stated that allowing the Riegel’s to build in a P-O area could have others wanting to do the same. The property was bought in 1979 and was bought knowing it was in a P-O area. Mr. Riegel took pictures of the property which were looked at. A motion was made by Jeff Metz and seconded by Bryon Ruhl to recommend to the Zoning Hearing Board that they deny the special exception application of Cheri & Ashley Riegel as applied for. ROLL CALL: Ayes-Balthaser, Confer, Ruhl, Edwards, Metz OLD BUSINESS None NEW BUSINESS The application for Skelly & Loy representing the Getty Mart was reviewed. They are seeking a variance to place a shed in the rear of the property that does not meet all the setback requirements. John Leonforte explained that a test done has found contamination and that DEP mandates a remediation be done on the property. There are test wells on the west side of the property and an alarm goes off if there is a leak. The shed is needed to house the equipment for this remediation. The shed is only temporary for about 3 years. There will be pumps inside that will make noise all night. The pipes go underground to the tanks and the shed will be insulated to keep the noise down. A motion was made by Dale Schlenker and seconded by Chuck Cuthbert to recommend to the Zoning Hearing Board to approve the application for Getty Mart. ROLL CALL: Ayes-Balthaser, Confer, Ruhl, Edwards, Metz, Cuthbert, Schlenker The variance application of Randy Gray was reviewed. Mr. Gray wants to build a house on the rear of his property at 400 South 4th Street and if it does not sell then use it as a warehouse for himself. As it stands Mr. Gray cannot meet the setback requirements. A variance was granted for this several years ago but Mr. Gray is enlarging the size of the house so he is seeking a variance. A motion was made by Chuck Cuthbert and seconded by Diana Edwards to recommend to the Zoning Hearing Board to accept the application as requested. ROLL CALL: Ayes-Balthaser, Confer, Ruhl, Edwards, Metz, Cuthbert, Schlenker A discussion was held about the current zoning ordinance. It has been worked on for several years but is never completed. It was decided to get copies made of the proposed ordinance for discussion at next month’s meeting to get it finished and adopted. There being no further business, and on motion of Dale Schlenker seconded by George Confer to adjourn the meeting at 8:24 p.m.
