MINUTES FROM THE FEBRUARY 21, 2005 MEETING OF THE PLANNING COMMISSION

The Hamburg Planning Commission met this evening in the Council Chambers of the Hamburg Municipal Center with Chairman Roy Heffner presiding.  The meeting was called to order at 7:00 p.m.

 MEMBERS PRESENT:  Dale R. Schlenker, Roy R. Heffner, Sylvia S. Summons, Neven J. Dries,  Heather A. Breininger, Lori M. Guldin, Richard W. Boyd

 MEMBERS ABSENT:  None 

ALSO PRESENT:  John Leonforte, Lynda G. Albright-Borough Manager, Denise L. Clare- Secretary

 A motion was made by Rick Boyd and seconded by Sylvia Summons to approve the January minutes as written.

OLD BUSINESS
 

Hamburg Commons Planning Module-This is a formality.  The EDU’s are already paid for.  The plans are through County Planning, the Hamburg Municipal Authority and Borough Council and have been approved.  The Planning Commission needs to approve it.

 A motion was made by Dale Schlenker and seconded by Sylvia Summons to accept the sewer planning module for Hamburg Commons.

John Leonforte has received plans for the Bickel Subdivision.  Forino is building the houses in Windsor Township.  A very small portion of the development is in the Borough and is not being developed.  It is part of a back yard area.  The Borough received a letter because of it being adjourning property.  The Planning Commission and Borough Council have been asked to waive any subdivision requirements.  The plans show 23 lots plus 1 residue lot.  Parts of 2 back yards are in the Borough.  Heather Breininger asked about water/sewer service.  Everything is self contained on each lot.  Lynda Albright stated that she has heard nothing.  Rick Boyd stated that the Ridge Lawn pump station should have the sewer tied into it.  Lynda Albright stated that that would be an issue since it is a force main.  Rick Boyd stated that it would be gravity fed.  Rick Boyd feels that the pump station should be noted somewhere on the plans.  Lynda Albright will mention it to Greg Unger and see if the Authority wants to pursue it.  Roy Heffner stated that a letter should be sent asking if tying into the Hamburg sewer system was thought about. 

 A motion was made by Rick Boyd and seconded by Heather Breininger to officially waive any presentation of detailed plans to the Planning Commission and for the developer to note and question why the sewer for the development will not be fed into the Ridge Lawn pump station.

John Leonforte handed out a report showing permits issued for the month of January 2005 and briefly went over it.  Roy Heffner asked if Cedar Shopping is the Ames development.  John Leonforte stated that yes it was.  John Leonforte stated that Redner’s is renovation and moving into the former Ames store.

 John Leonforte stated that if there was no further business that he had a topic for Planning Commission discussion.  The topic is signage for the Redner’s and Hamburg Commons developments.  In the zoning ordinance it limits on premise signs to an aggregate area of 160 sq. ft. of signage.  John Leonforte feels an amendment for a special exception should be provided for properties located in the VC & BD districts to allow more signage.  Rick Boyd asked what was done in the VC downtown area.  John Leonforte was only thinking about shopping centers and strip malls not the downtown area.  Heather Breininger asked if you could correlate the square footage of retail space to signage.  Lori Guldin asked if there was a fee for the special exception.  John Leonforte stated that there was and any fees incurred (stenographer, ads, etc.) would be the applicants responsibility.  Also sign height above roofs needs to be addressed.  The zoning ordinance does not allow for it.  Dale Schlenker feels it is a valid request to go for a special exception.  Lori Guldin asked for a draft be done for the Planning Commission members to review.  Rick Boyd asked what needed to be drafted.  It just needs to be changed in the ordinance to read what areas are affected (VC, IPR and BD districts).  Lori Guldin asked how much would be paid for this application.  John Leonforte stated what ever it would costs to do.  Rick Boyd stated the fee should be defined in the special exception section of the ordinance.  Roy Heffner stated that it should be decided tonight or draft it for the net meeting.

 A motion was made by Rick Boyd and seconded by Heather Breininger to add the words under the signage requirements for the VC, BD and IPR zones that a special exception can be applied for and costs are to be paid by the applicant.

 A motion was made by Rick Boyd and seconded by Neven Dries to add Section 803.1.5.3 the words that all associated costs shall be reimbursed for the requested special exception by the applicant (as stated in Section 710.2 on page 114).

John Leonforte stated that there will be an election this year for Borough Tax Collector.  John Leonforte asked is this a business or a government service?  Does it fall under in home occupation or no impact home business or is it exempt?  Rick Boyd stated he thought home occupation.  If the tax collector lives in a residential district then it falls under in home occupation.  If in the VC district it would be office use.  The required 2 parking spaces besides the residential use space would be needed a the residential district.  If it is in a VC district they would only need 1 space for 300 sq. ft. of floor space.

Rick Boyd asked what joint planning is doing right now.  Roy Heffner stated that at this point, nothing.  Dale Schlenker stated that Strausstown has now accepted the joint comprehensive plan.  Electronic copies will be available after everything is completed.  Lori Guldin asked if anyone was in regarding Penn Dot and the traffic light moving.  No one has heard anything.

 There being no further business, and on motion of Sylvia Summons and seconded by Heather Breininger to adjourn the meeting at 7:59 p.m.
